FACT #1 : CMPSA staff gave us the following facts: In February 2003 a gentleman from the local FCC office requested to come and inspect CMPSA's FCC licenses. He came to their office stating he had received a written complaint but told them the complaint was secret and could not say who filed the complaint. They had asked him what the complaint was about and were only told that it's "a complaint". The gentleman did inspect CMPSA's FCC licenses and focused on questioning one particular call sign. After showing the agent dozens of documents that substantiated the reasoning, he didn't push on further. The end result was mailed in writing to CMPSA to fill in some answers on several letters; which they did & mailed back. The final outcome of the FCC was ruled that "No legitimate complaint ever existed and the FCC found no violations and every FCC license was in possession and all proven to be valid and radio systems to be in compliance with the license specifications." So it appears Mr. Sutherland filed the false complaint to harass CMPSA which a end result was CMPSA lost a key FCC license intended for two-way radio interoperability for all public safety agencies. It was also told to us that Mr Sutherland was telling everyone CMPSA was competing for grant money for radio interoperability frequencies and the state police competition had to be stopped. To this day it is still unclear the intent of the false FCC complaint filed by the Massachusetts State Police employee.
FACT #2 : THE ABOVE DOCUMENT WAS SUBMITTED TO TROOPER SANCHEZ AND HENCE BECAME "CRIMINAL EVIDENCE - EXHIBIT 5" USED TO CHARGE MR. BARIL WITH FOUR CRIMINAL OFFENSES & REVOKE CMPSA'S LICENSE PLATES. AS YOU CAN SEE THIS 2003 LETTER HAS ABSULUTELY NOTHING TO DO WITH RMV ISSUES.
CONCLUSION : WHAT WAS A SHOCK TO CMPSA STAFF THE DAY OF THE RMV HEARING (8/16/06), WAS SEEING THIS DOCUMENT FOR THE VERY FIRST TIME WHICH REVEALED WHO FILED THE FALSE/FICTICIOUS COMPLAINT AGAINST CMPSA. LASTLY, THE GENTLEMAN WHO WROTE IT ON COMMONWEALTH OF MA LETTERHEAD, SIGNED HIS NAME TO IT THAT IT WAS PRESENT AT THE RMV HEARING TO TESTIFY AGAINST CMPSA FOR TROOPER SANCHEZ AND ALSO THERE WITH FORMER CO-WORKER PETER J. OSTROSKEY, THE UXBRIDGE FIRE CHIEF.
